Terms of Service
These Terms of Service govern your use of the Carvory mobile application and related pages. By using Carvory, you agree to these Terms. If you do not agree, do not use the service.
1. The Carvory Service
Carvory is a private ski-day journal and curated editorial experience. You may create local Ski Day records, add photos, review editorial content, save items, and obtain consumable Trail Stamps through Apple In-App Purchase.
Carvory does not provide public user posts, public comments, follower or following relationships, direct messages, public chat, or a public profile directory.
2. Eligibility and Anonymous Access
You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or guardian must review and accept these Terms for you.
Carvory provides anonymous quick login and does not require an email address or password. Your login state is stored locally. There is no account-recovery feature. You are responsible for maintaining access to and security of your device.
3. Your Private Content
You retain any rights you have in Ski Day notes and photos that you add. You represent that you have the right to use that content and that it does not violate law or another person’s rights. Your journal content is intended for private, local use and is not published to other users through Carvory.
You are responsible for maintaining any backups you want. Deleting the app, deleting your account, losing the device, or resetting local storage may permanently remove local records. Carvory does not promise recovery of deleted or unavailable local data.
4. Acceptable Use
You must not:
- use Carvory for unlawful, fraudulent, harmful, threatening, abusive, or exploitative activity;
- attempt to bypass safety filters, access controls, purchase verification, or technical restrictions;
- interfere with the app, hosting infrastructure, reporting process, or another person’s device or rights;
- submit false, malicious, or repetitive reports intended to harass or disrupt safety review;
- reverse engineer the service except where applicable law expressly permits it; or
- use automated means to scrape, overload, or abuse the service.
5. Content Safety: Report, Block, and Filter
Applicable editorial or platform-provided content includes accessible Report, Block, and Filter controls. You may report content that appears unsafe, unlawful, abusive, or otherwise inappropriate; block a content source from appearing to you; and apply available content filters.
We may review reports, restrict or remove content, limit a source, preserve evidence, or contact relevant authorities when reasonably necessary. We may reject reports that are unfounded, abusive, or submitted in bad faith. A report does not guarantee a particular outcome.
6. Trail Stamps and In-App Purchases
Trail Stamps are consumable virtual points available only for permitted features inside Carvory. Purchases are offered through Apple’s In-App Purchase system and are subject to Apple’s purchase terms, pricing, billing, tax, and refund processes.
- Trail Stamps have no cash value and cannot be redeemed, transferred, traded, or sold.
- Prices shown by Apple at the time of purchase control and may vary by storefront or tax.
- A completed, verified transaction must be received before Trail Stamps are delivered.
- Consumable purchases do not include a Restore Purchases function. Interrupted delivery may be completed automatically through Apple transaction processing.
- Unless required by law, refunds are handled under Apple’s policies and processes.
We may correct a balance affected by fraud, a duplicate credit, a reversed transaction, or a technical error. You must not manipulate or attempt to create an unauthorized Trail Stamp balance.
6A. Platform Sample Activities
The Discover area may contain clearly labeled Platform Sample activities used to demonstrate the activity experience. These prototype listings are mock data and are not live resort events, confirmed reservations, transportation, instruction, or safety services.
Joining a sample activity uses the displayed number of Trail Stamps and saves the joined state locally. A repeated join does not intentionally charge twice. Trail Stamps used for a sample activity do not create a contract with a resort, host, venue, or other attendee and do not guarantee that a real-world event will occur.
7. Editorial Content and Intellectual Property
Carvory, its visual design, software, editorial material, branding, and other service content are protected by intellectual-property laws. Except for the limited right to use the app for personal, noncommercial purposes, no rights are granted to copy, distribute, modify, sell, or create derivative works from Carvory content.
8. Third-Party Services
Apple and other necessary service providers may support purchases, operating-system permissions, diagnostics, or hosting. Their own terms and privacy policies govern their services. Carvory is not responsible for third-party services outside its reasonable control.
9. Account Deletion and Termination
You can delete your account from the in-app settings. This action clears Carvory’s local login state, journal history, locally referenced photos, content preferences, Trail Stamp balance, and purchase-related local state. Because there is no recovery feature, deletion is intended to be permanent.
We may suspend access to online portions of the service when reasonably necessary to protect users, investigate misuse, comply with law, or enforce these Terms. Sections that by their nature should survive termination—including purchase restrictions, intellectual property, disclaimers, liability limits, and dispute terms—will survive.
10. Service Changes and Availability
We may update, improve, suspend, or discontinue features. We do not guarantee uninterrupted or error-free access. Skiing and mountain activities involve inherent risk; Carvory is a journaling and editorial product and is not navigation, weather, avalanche, medical, rescue, or emergency-safety equipment.
11. Disclaimers
To the maximum extent permitted by law, Carvory is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, or uninterrupted availability. Nothing in these Terms excludes warranties that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, Carvory and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from the service. Any liability that cannot be excluded is limited to the greater of the amount you paid to Carvory in the 12 months before the claim or USD 50, unless applicable law requires a different limit.
13. Indemnity
Where permitted by law, you agree to defend, indemnify, and hold harmless Carvory and its providers from claims arising from your unlawful use of the service, breach of these Terms, or violation of another person’s rights.
14. Governing Terms
These Terms are governed by the laws applicable to the Carvory service provider, excluding conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Before filing a formal claim, contact Support and allow a reasonable opportunity to resolve the issue informally.
15. Changes to These Terms
We may update these Terms as the service or legal requirements change. The revised Terms will show a new “Last updated” date. Continued use after an update takes effect constitutes acceptance where permitted by law.
